  1. PromoterThe promoter of the prize draw (“Prize Draw”) detailed in these terms and conditions (“Terms”) is STEAMhouse on behalf of Birmingham City University, a higher education institution whose main administrative offices are at University House, 15 Bartholomew Row, Birmingham, B5 5JU (“Promoter”).

 

  1. Eligibility(a.) The Prize Draw is open to entrants who have been invited by the Promoter to complete an online survey in respect of new product development needs (“Survey”), excluding the Promoter’s employees, officers, any family member of such employees/officers, or any person directly associated with the administration of the Prize Draw.

    (b.) The opening date for entries is 20th
    October 2022. The closing date of the Prize Draw is 23:59 (UK time) on 4th
    November 2022. Any entrant who completes the Survey in all material aspects and submits the completed version in accordance with the instructions of the Survey by 23:59 (UK time) on 4th
    November 2022 will be eligible to enter into the Prize Draw. Late entries will not be accepted.

    (c.) By entering into this Prize Draw, an entrant is deemed to have accepted these Terms.

    (d.) For the avoidance of doubt, any natural person entrant shall be aged 18 years or over.

 

  1. Free to EnterThe Prize Draw is free to enter and no purchase is necessary.

 

  1. Rules for the Prize Draw (a.) Only one entry will be accepted from each entrant.(b.) The entrants must grant permission for the Promoter to use their entry for the purpose of organising and/or managing the Prize Draw, for announcing the Winner (as defined below) of the Prize Draw and for general marketing purposes (where applicable).

    (c.) The Promoter reserves an absolute and unconditional right to disqualify any entrant and/or Winner of the Prize Draw in its absolute discretion for any reason and without notice.

    (d.) The Promoter shall not be responsible for any misleading, inaccurate or incomplete prize details supplied to any entrant by any third party connected with this Prize Draw.

    (e.) The Promoter reserves the right to hold, void, cancel, suspend, or amend the Prize Draw where it becomes necessary to do so (including without limitation the occurrence of any unforeseen circumstances outside its reasonable control) with no liability to the entrants or any third party.

 

  1. Winning Entrant(a.) One winning entrant (“Winner”) will be drawn at random by independent electronic means on 7th November 2022 from all valid entries received by the Promoter by 23:59 (UK time) on 4th November 2022.(b.) The Promoter shall notify the Winner of the winning of the Prize Draw by email (using the identical details as provided at time of entry into the Prize Draw) on 7th November 2022.

    (c.) The prize is 1 calendar year of free Affiliate membership with the STEAMhouse. The decision of the Promoter will be final and conclusive and no correspondence will be entered into.

    (d.) The Winner must be able to accept the prize within 14 days of being informed of the winning entry and perform all reasonably necessary acts which facilitate the Promoter to award the prize. The prize is non-exchangeable and non-transferable. If the Winner fails to do so the prize will lapse. In such circumstances the Winner will not be entitled to any other form of award in cash or in kind from the Promoter. The Promoter, may at its sole and absolute discretion, draw at random another entrant from the valid entries (excluding the original Winner) as the replacement winning entrant who shall comply with the obligations contained in this proviso.

    (e.) In the unlikely event that at the time the prize is drawn, the prize is not available, the Promoter reserves the right to substitute the prize with a replacement prize which, in its sole and absolute opinion, is generally comparable to the original prize.

    (f.) The Promoter may be required by applicable laws and regulations to publish or make available information that indicates that a valid award took place. In such circumstances, the Promoter will send the surname and county of the Winner (and any replacement Winner) and, if applicable copies of his/her/their winning entries, to anyone who emails steamhouse@bcu.ac.uk within one month after the closing date stated in clause 2(b). If the entrant objects to any or all of his/her surname, county and winning entry being published or made available, please contact the Promoter via steamhouse@bcu.ac.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request. Please see clause 7 which contains further details around how the entrant’s personal data will be processed.

 

  1. Limitation of Liability(a.) The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.(b.) The Promoter does not exclude or limit its liability in any circumstances where it is prevented from doing so by the laws of England and Wales. Except in such circumstances, the Promoter’s maximum liability to an entrant in any way connected with this Prize Draw and/or the prize, whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the value of the prize.

 

  1. Personal DataBy entering into this Prize Draw, an entrant agrees that the Promoter may use his/her data for the purpose of administering the Prize Draw, contacting the Winner, and complying with its statutory obligation to publish or make available information that a valid award has taken place (as detailed in clause 5(f)). An entrant’s personal data will be dealt with in accordance with the applicable privacy policy: https://steamhouse.org.uk/privacy-policy/.

 

  1. Intellectual PropertyAll entries and any accompanying material submitted to the Promoter will become the property of the Promoter.

 

  1. SeverabilityIf any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, then that invalid, illegal or unenforceable provision (or any part thereof) shall be deleted and the validity, legality and enforceability of the remaining provisions shall not be affected.
  1. Jurisdiction and Governing LawThese Terms are governed by English law and the entrants and the Promoter submit to the exclusive jurisdiction of the English courts.
